Target persons
Access to the reception system of international and temporary protection
The persons to whom the conditions of the international protection reception system apply are:
- Applicants and beneficiaries of international protection in Spain
- Persons applying for and receiving stateless status
- Applicants and beneficiaries of temporary protection: Ukraine Urgent
The recipients must lack sufficient financial resources and comply with the requirements of access and stay in the reception system provided in the Regulation approved by Royal Decree 220/2022, of 29 March.
End of the reception
The reception conditions end for the following reasons:
- Lack of formalization, inadmissibility, refusal or withdrawal of the application for international protection of temporary protection or statelessness.
- Cessation or revocation of refugee status or subsidiary protection granted.
- Access to financial resources when these exceed the amount of benefits received.
- End of the period of the program or specifically authorized service.
- Abandonment of the assigned reception centre or facility without informing those responsible
- Violation of the basic operating rules of the center or the rights of other residents or staff, as well as the disruption of coexistence.
Rights of the system
Everyone in the reception system has the following rights:
- To the necessary actions and services that ensure the satisfaction of their basic needs in conditions of dignity,
- To the rights granted to applicants for international protection in Law 12/2009,
- To be informed, in a language they understand, about the conditions of the International Protection Reception System and the reception resource, their rights and duties as user persons, as well as the causes for the reduction or withdrawal of the reception conditions. Where the recipients are minors, a procedure shall be established to ensure access to information appropriate to their age and maturity and the right to be heard.
- To know the rights and duties relating to his administrative situation, as well as the requirements for his stay in the resource of the reception system of international protection that has been assigned to him.
- To receive comprehensive attention for the recovery of the violence that, if applicable, had been suffered previously or in the context of displacement.
- To make use of the services and activities provided in the reception resource.
- To be informed of any changes in the system of operation of the resource, as well as possible transfers to other resources in due time.
- To contact the personnel responsible for the assigned resource and use the established channels to formulate the requests and claims related to their treatment or the system they may formulate.
- To the confidentiality of personal data.
- To communicate with their relatives, with their legal advisers or advisers, with persons representing UNHCR and with other competent national, international and non-governmental organizations and bodies.
Obligations
Everyone in the reception system has the following obligations:
- Respect the rules of basic functioning and coexistence of the centers and resources of the Reception System and do not violate the rights of other residents or the personnel in charge of the centers where they are hosted.
- Do not leave the assigned reception center or device without informing those responsible.
- Inform of their financial resources if they are sufficient to pay for the established reception benefits.
